These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) apply, without restriction or reservation, to seasonal rentals as offered by the non-professional service provider to clients on the website https://villa-roland-en-bourgogne.fr.

The main features of the services offered are presented on the website https://villa-roland-en-bourgogne.fr.

Clients are required to read these carefully before making any reservation. The choice and purchase of a service are the sole responsibility of the Client.

These GTC are accessible at any time on the website https://villa-roland-en-bourgogne.fr and shall prevail over any other document.

The client declares having read and accepted these GTC by checking the box provided for this purpose prior to initiating the online booking process on the website https://villa-roland-en-bourgogne.fr.

Unless proven otherwise, the data recorded in the provider’s computer system constitutes proof of all transactions with the client.

The services are provided at the rates in effect on the website https://villa-roland-en-bourgogne.fr at the time the reservation is recorded by the provider.

Prices are in Euros and include VAT.

The rates take into account any discounts that may be granted by the provider on the website https://villa-roland-en-bourgogne.fr.

These rates are firm and non-revisable during their validity period, but the provider reserves the right to modify prices at any time outside of this period.

The amount requested from the Client corresponds to the total purchase amount, including any applicable fees.

The client must select the desired booking period on the website https://villa-roland-en-bourgogne.fr, where availability and pricing are clearly displayed. Reservations are made through online payment by credit card via PayPal.

The reservation is only considered valid after full payment of the price. It is the client’s responsibility to verify the accuracy of the reservation and to report any errors immediately.

Any reservation made on the website https://villa-roland-en-bourgogne.fr constitutes a distance contract between the client and the provider.

The provider reserves the right to cancel or refuse any reservation from a client with whom there is a dispute concerning payment of a previous booking.

Note: Reservations can also be made via platforms such as Abritel (VRBO), Booking, and AIRBNB.

The price is paid through secure payment using one of the following methods:

• Online payment by credit card via PayPal
• Bank transfer to the provider’s account (details provided upon reservation request)

Payment is due under the following schedule:

• First payment: 50% on the day of booking
• Second payment: 50% 30 days before arrival

Late payment will result in the immediate demand for all amounts owed, without prejudice to any other actions the provider may be entitled to pursue. In addition, the provider reserves the right to suspend or cancel the reservation in case of non-compliance with payment terms.

Payment data is encrypted using a protocol defined by the authorized payment provider handling banking transactions on the website.

Payments are considered final only after full receipt by the provider.

The provider is not required to deliver the reserved services if the full payment has not been received under the specified conditions. A security deposit of €200 is required upon arrival after an inventory check with the provider. This deposit will be returned upon departure after a second inventory check.

Reservations are defined as follows:

• Rental of a 125 m² 4-star furnished holiday home for up to 5 people, located on a 1000 m² plot, for a minimum of 3 days (1 week minimum in high season). Bed linen, bath towels, and table linens are provided.

The full payment must be completed before the guests arrive at the rental property under the terms defined in these GTC and sent to the address specified by the client during reservation.

Due to the nature of the services provided (seasonal rental), online reservations do not qualify for the right of withdrawal.

The contract is therefore final upon online booking as per the present GTC.

If the client cancels 30 days before arrival, no fee will be charged and the deposit will be refunded within 30 days.

If the client cancels 15 days before arrival, the provider will retain the deposit paid at the time of reservation.

Clients are informed that the collection of their personal data is necessary for the sale and delivery of services provided by the provider. These personal data are collected solely for the purpose of executing the service contract.

Personal data collected on the site:

• During reservation: first name, last name, mailing address, phone number, and email address.
• Payment-related financial data (bank or credit card details) are not stored by the site.

The data is intended solely for the provider’s use.

The data controller is the provider, under the French Data Protection Act and, as of May 25, 2018, under Regulation (EU) 2016/679 (GDPR).

Unless expressly agreed by the client, their data will not be used for marketing purposes.

The data will be stored for 5 years, in accordance with the applicable statute of limitations for contractual liability.

The provider uses appropriate organizational, technical, software, and physical safeguards to protect personal data. However, the internet is not completely secure, and the provider cannot guarantee the absolute security of data transmitted or stored online.

In accordance with applicable regulations, users have the right to:

• Update or delete their data via the contact form
• Delete their account by writing to the contact in section 9.3
• Access their data by contacting the data controller (see 9.3)
• Correct inaccuracies by contacting the data controller
• Request data deletion under applicable laws
• Request data portability to another provider
• Object to data processing

These rights may be exercised, as long as they do not interfere with the purpose of data processing, by contacting the provider via the above contact details. A response must be given within one month. If the request is denied, the client may file a complaint with the CNIL (3 Place de Fontenoy, 75007 PARIS) or take legal action.

Clients may be asked to check a box indicating consent to receive informational or promotional emails. Consent can be withdrawn at any time by contacting the provider or clicking the unsubscribe link.

Any full or partial reproduction is strictly prohibited and may constitute counterfeiting.

These GTC and related transactions are governed by and subject to French law.

These GTC are written in French. In the event of translation, only the French version will be binding in the event of a dispute.

The client is informed that they may resort to conventional mediation, sectoral mediation bodies, or alternative dispute resolution methods (such as conciliation) in case of dispute.
